Innocent Spouse

There are times when a taxpayer's spouse doesn't know that any income was earned or that a deduction was taken which should not have been claimed or couldn't be proven and now because of that the taxpayer spouse, because of his or her lack of knowledge or because he or she reasonably shouldn't have even known about this unreported income or claimed expenses or tax liability, is jointly and severally liable with his or her spouse or ex spouse to the IRS for tax debt. When a tax return is filed as married filing jointly both spouses by signing generally accept joint and separate liability which means that each spouse on their own is 100% liable for the tax debt and the IRS could pursue the whole tax debt from one of the spouses, and in most cases the IRS will take such action regardless of what a divorce decree says.
